The DDA shall install signage marking the boundaries of the Commons Area at all locations displayed in the Commons Area map. Such signage shall include the logo, emblem, or mark of the Social District and the words “Middleville Social District Boundary.” 

The Director shall design a logo, emblem, or other mark that is unique to the Commons Area and includes the word “Middleville.” The Director shall then present this mark to the DDA for approval. The mark may only be changed by approval from the DDA. In the event that the mark is changed, the Director must notify all social district permittees of the new mark within thirty (30) days and replace all boundary signage within ninety (90) days.

No individual other than those authorized by statute, these Plans, or the DDA shall utilize the mark.

All qualified licenses, as described in Part 551 of the Act, must comply with all requirements of the Act.

Qualified licensees who hold a social district permit may sell alcoholic liquor for consumption within the confines of a Commons Area if both of the following requirements are met:

1. The holder of the social district permit sells and serves alcoholic liquor on the holder’s licensed premises.
2. The holder of the social district permit serves alcoholic liquor to be consumed in the Commons Area only in a container to which all of the following apply:
   1. The container prominently displays the social district permittee’s trade name or logo or some other mark that is unique to the social district permittee under the social district permittee’s on-premises license.
   2. The container prominently displays a logo or some other mark that is unique to the Commons Area.
   3. The container is not glass.
   4. The container has a liquid capacity that does not exceed 16 fluid ounces.

No qualified licensee is permitted to sell alcoholic liquor for consumption in the Commons Area without a valid social district permit from the Michigan Liquor Control Commission after obtaining approval from the Village.

If the Michigan Liquor Control Commission issues a special license to a special licensee whose event is to be held within the Commons Area, for the effective period of the special license, and subject to the Liquor Control Commission’s approval, the Village Council shall delineate the portion of the Commons Area to be utilized exclusively by the special licensee and the portion of the Commons Area to be used exclusively by social district permittees.

Any individual who has purchased alcoholic liquor from a qualified licensee holding a social district permit may consume alcoholic liquor subject to the requirements of the Act and these Plans.

A purchaser may remove a container of alcoholic liquor sold by a holder of a valid social district permit issued by the Michigan Liquor Control Commission from the social district permittee’s licensed premises if both of the following conditions are met:

1. Except as otherwise provided in subsection (b), the purchaser does not remove the container from the Commons Area.
2. While possessing the container, the purchaser does not enter the licensed premises of a social district permittee other than any of the following:
   1. The social district permittee from which the purchaser purchased the container.
   2. A social district permittee whose licensed premises is a class B hotel.

Purchasers may not carry or consume alcoholic liquor on a public street within the Commons Area except in the following circumstances:

1. If the alcoholic liquor is in a closed container, to and from a vehicle, and while driving said vehicle, subject to the Michigan Vehicle Code and other laws.
2. To cross the street from one sidewalk or public space to another via a designated crosswalk.
3. In areas of the street which have been closed to traffic by the Village or a law enforcement agency for a special event.
4. In areas where a restaurant, bar, or other establishment has been permitted to install tables, chairs, and other equipment for use by patrons.

All alcoholic liquor containers and their contents must be disposed of in a garbage or recycling receptacle.

Any qualified licensee seeking to obtain a social district permit from the Michigan Liquor Control Commission must first obtain approval from the Village Council. Such licensee may do so by submitting to the Village Clerk the following:

1. Completed Village Social District Permit Application Form.
2. Completed Michigan Liquor Control Commission Social District Permit Application.
3. A Local Government Unit Approval for Social District Permit form with the licensee’s name filled in.
4. Certificate of liability insurance naming the Village of Middleville as an additionally insured.
5. Narrative describing the licensee’s proposed use of the Commons Area, type of establishment, the licensee’s use of alcoholic liquors, and plan to comply with the requirements of the Act.
